In Youngstown Sheet & Tube Co. v. Sawyer (1952)\, President Truman attempted to seize control of steel mills during the Korean War\, raising urgent questions about the scope of executive power. Justice Robert H. Jackson’s concurring opinion provided a careful framework for evaluating when presidential actions exceed constitutional limits\, balancing national needs with adherence to the law. \nThis lecture will examine Jackson’s reasoning in detail\, exploring the three-tiered framework he established for assessing executive authority and the enduring impact it has on debates over presidential power. From emergency actions to everyday decisions\, Jackson’s insights continue to guide legal scholars\, policymakers\, and the public in understanding the delicate balance between effective leadership and constitutional restraint. Attendees will leave with a deeper appreciation for the ways in which Jackson’s thought shapes modern governance and the protections that uphold democratic principles in times of crisis. \nAbout the SpeakerGerard N. Magliocca is a Distinguished Professor and the Lawrence A. Jegen III Professor at the Indiana University Robert H. McKinney School of Law. He is the author of five books on constitutional law\, including his new book The Actual Art of Governing: Justice Robert H. Jackson’s Concurring Opinion in the Steel Seizure Case\, which offers a deep analysis of Jackson’s landmark concurring opinion and its continuing relevance to presidential power today. His biography of Justice Bushrod Washington won the Erwin N. Griswold Prize from the Supreme Court Historical Society. \nProfessor Magliocca earned his undergraduate degree from Stanford and his law degree from Yale. He joined the Indiana University faculty in 2001 after two years as an attorney and one year clerking for Judge Guido Calabresi on the U.S. Court of Appeals for the Second Circuit. He has held the Fulbright-Dow Distinguished Research Chair at the Roosevelt Study Center in the Netherlands and was a Fellow at the Washington Library at Mount Vernon. \nCopies of The Actual Art of Governing: Justice Robert H. Cohen is a seasoned attorney with more than forty years of experience in civil litigation\, appellate advocacy\, and legal writing\, with deep expertise in the jurisprudence of the U.S. Supreme Court. Over his career\, he wrote and edited more than a thousand briefs for courts at every level\, distilling complex constitutional questions into clear\, persuasive arguments. Edward White is the David and Mary Harrison Distinguished Professor of Law at the University of Virginia School of Law and one of the nation’s most respected scholars of American legal history. SUMMARY:25 Years of Asking Questions: Who Gets to go to School?
DESCRIPTION:From school segregation and busing to book bans\, charter schools\, and modern achievement gaps\, the fight for educational equity has long reflected the nation’s broader struggle to live up to its democratic ideals. In her lecture\, The Politics of U.S. Public Schooling: Tinkering Toward and Away from Dystopia\, Dr. Melinda Lemke invites attendees to examine how far we’ve come since Brown v. Board of Education\, and what still divides us. Through this conversation\, we aim to explore the legal\, cultural\, and policy battles that have shaped access to education in America\, and to encourage reflection on what “equal education” should mean in the 21st century. \nThe discussion is grounded in the legacy of Robert H. Jackson’s final Supreme Court case\, Brown v. Board of Education\, 347 U.S. 483 (1954)\, the landmark decision that declared segregation in public schools unconstitutional. The ruling affirmed that equality in education is essential to equality in citizenship\, an idea that continues to challenge our laws\, institutions\, and collective conscience. \nAbout the SpeakerMelinda Lemke\, Ph.D.\, is an Associate Professor of Educational Policy and affiliated faculty in Global Gender and Sexuality Studies at the Universityat Buffalo (UB)\, SUNY. Dr. Lemke is a qualitative methodologist\, and her research focuses on the politics of education and how social policies address structural violence to improve the health\, well-being\, and human rights of women and girls. This includes examining the causes\, effects\, discourses concerning\, and public system responses to gender-based violence and the largescale internal and cross-border displacement. \nDr. Lemke’s work in higher education is informed by a previous career in U.S. public secondary education and work in sexual assault prevention and advocacy. She is actively involved in shared governance at UB\, SUNY\, serving for example as faculty senator elect and as United University Professionals Buffalo Center Chapter Grievance Officer for Academics. Dr. Lemke is the author of more than 60 publications and is the recipient of multiple research and practice awards\, including most recently the Paula Silver Case Award for co-authored research on human trafficking and the Dr. Conrad F. Toepfer\, Jr. Award for doctoral mentorship.

Through this conversation\, we aim to provide historical\, legal\, and civic context that helps the public better understand how free speech shapes our democracy\, and how we can navigate the challenges of truth\, safety\, and open discourse in a rapidly changing world. \nThis conversation is grounded in the legacy of Robert H. Jackson\, who wrote in West Virginia State Board of Education v. Barnette\, 319 U.S. 624 (1943) that “freedom to differ is not limited to things that do not matter much.” Jackson’s words remind us that the right to speak\, dissent\, and challenge authority lies at the heart of democratic life\, a principle that remains as vital and contested today as it was in his time. \nAbout the SpeakerOur featured speaker\, Aaron Saykin\, leads the Media and First Amendment Practice at Hodgson Russ LLP in Buffalo\, where he advises clients on defamation\, free speech\, and access-to-information issues under New York’s Open Meetings and Freedom of Information Laws.
